The site may offer free content, paid VIP membership tiers, member features, community tools, and branded merchandise fulfilled through white-label or print-on-demand fulfilment partners where applicable.

By accessing or using simpledavy.com, creating an account, purchasing merchandise or memberships, submitting content, or using Simple Davy™ features or services, you agree to these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, do not use the site or services.

You must be at least the age of majority in your place of residence to purchase paid offerings, unless a higher age or parental-consent requirement applies. You are responsible for your login credentials and all activity under your account. Simple Davy™ may suspend or terminate accounts for suspected abuse, infringement, fraud, payment issues, platform violations, or safety concerns.

• Free content: streaming, editorial, informational, entertainment, and community-facing content.
• VIP memberships or subscriptions: access to tier-based exclusive posts, media, and community perks. Access begins once payment is confirmed.
• Merchandise: fulfilled on demand by Printful or a similar provider where applicable. Mockups are illustrative; minor variations may occur due to on-demand production.
• Community features: users or members may create profiles, submit content, post blogs, comment, or participate in community features where enabled. See “User Content & Community Rules.”

Simple Davy™ may change, add, remove, pause, or restrict features, pricing, benefits, or availability at any time, including for maintenance, safety, platform, business, or legal reasons.

Simple Davy™ accepts major payment methods supported by its platform and connected providers, which may include credit/debit cards, PayPal, digital wallets, or other options. Where available, in-person payments may be processed through eligible point-of-sale systems, and online payments may be processed through Wix Payments, PayPal, Stripe, or other connected providers. Availability depends on region and provider approval.

Displayed prices may exclude taxes, duties, shipping, platform fees, or other charges until checkout. You are responsible for any applicable taxes or fees in your jurisdiction.

Unless stated otherwise, memberships and subscriptions renew automatically at the stated interval until cancelled. You can cancel anytime from your account where supported; access continues through the paid-through date. See the Simple Davy™ Refund Policy for refunds and exceptions.

Title and risk of loss transfer to you upon carrier acceptance unless applicable law states otherwise. Delivery estimates are not guarantees. Customs, duties, taxes, import fees, or local handling charges, if any, are your responsibility.

You retain rights to content you submit (“User Content”), but grant Simple Davy™ and its operator a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, adapt, and share it on the site, social channels, and related promotional channels solely to operate, moderate, improve, and promote Simple Davy™.

You agree not to post anything unlawful, infringing, defamatory, harassing, hateful, abusive, deceptive, spam-like, or that violates privacy, intellectual property, platform, or community rules. We may moderate, remove, restrict, or disable content or accounts at our discretion.

All site content, excluding User Content, is owned by Simple Davy™, its operator, or its licensors and is protected by copyright, trademark, and other intellectual property laws in applicable jurisdictions and internationally.

Simple Davy™ and associated names, logos, graphics, merchandise designs, and brand identifiers are protected intellectual property. You may not copy, reproduce, distribute, display, modify, or create derivative works from this content without prior written consent, except where permitted by applicable law. Unauthorized use of trademarks or content may result in legal action.

Simple Davy™ may display near-realtime livestreaming, video, channel, social, and related information using external APIs, such as YouTube Data API v3 or similar services. This data is used solely for site functionality and is stored ephemerally where feasible. It is not archived once no longer valid unless needed for site operation, diagnostics, fraud prevention, security, or compliance with applicable API or platform policies.

By using features on simpledavy.com that rely on YouTube API Services, you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms) in addition to our Terms & Conditions. Your use of YouTube is also subject to the Google Privacy Policy (http://www.google.com/policies/privacy).

Simple Davy™ may integrate payment providers, fulfilment partners, analytics services, social platforms, embedded media players, livestream tools, and other third-party services. Their terms and privacy practices apply when you use those services.

Where simpledavy.com embeds a third-party widget or player, the embedded content may display basic live or public details such as names, icons, media status, online status, avatars, invite/join actions, playback information, or platform metadata. This content is provided directly by the third party and may change based on that provider’s features and your privacy settings. Simple Davy™ does not control the availability or data shown by third-party services.

You agree not to: (a) breach laws or rights, (b) attempt to access non-public areas, (c) interfere with security or operation, (d) use scraping, automation, or excessive requests that burden the service, (e) circumvent paywalls or DRM (Digital Rights Management), or (f) misuse Simple Davy™ content, accounts, services, or community features.

Simple Davy™ services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation. Content may contain opinions, satire, commentary, speculation, or errors; do not rely on it as professional advice.

To the extent permitted by law, Simple Davy™ and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits/revenue. Aggregate liability for claims relating to the services will not exceed the amounts you paid for the applicable offering in the three (3) months before the claim, except where such limitation is prohibited by law.

You agree to defend, indemnify, and hold Simple Davy™ and its operator harmless from claims arising out of your User Content, misuse of the site or services, or violation of these Terms or applicable laws.

Simple Davy™ may update these Terms by posting a notice on simpledavy.com with a new “Last updated” date. Continued use of the site or services constitutes acceptance of the updated Terms.

These Terms are governed by the laws applicable to the operator of Simple Davy™ and simpledavy.com, without regard to conflict-of-law principles, except where local consumer laws provide otherwise. Any court or venue requirements are subject to applicable law and the jurisdiction terms posted by the operator.
